Regulations on the Operation of Open Positions and Public Recruitment Positions, Article 11 (Restrictions on Appointment of Persons Given Open Appointments to Other Positions, etc.)

① 개방형임용 당시 경력직공무원이었던 사람은 개방형 직위의 임용기간에 다른 직위에 임용될 수 없다. 다만, 다음 각 호의 어느 하나에 해당하는 경우는 예외로 한다. <개정 2013.3.23, 2014.11.19, 2023.1.3>

② 제1항 각 호 외의 부분 단서에 따라 개방형 직위에 임용된 사람을 다른 직위에 임용할 때에는 제10조제1항부터 제3항까지의 규정에 따른 임용기간이 만료된 경우에 준하여 임용하여야 한다.

③ 제2항에 따라 개방형 직위에 임용된 사람을 다른 직위에 임용할 때 임용을 위한 결원이 없는 경우에는 최초로 결원이 발생할 때까지 정원이 따로 있는 것으로 보고 임용할 수 있다. 다만, 해당 기관 내에서 전보하는 경우에는 정원이 따로 있는 것으로 보지 아니한다.
