감정평가 및 감정평가사에 관한 법률 제25조(성실의무 등)

① 감정평가법인등(감정평가법인 또는 감정평가사사무소의 소속 감정평가사를 포함한다. 이하 이 조에서 같다)은 제10조에 따른 업무를 하는 경우 품위를 유지하여야 하고, 신의와 성실로써 공정하게 하여야 하며, 고의 또는 중대한 과실로 업무를 잘못하여서는 아니 된다. <개정 2020.4.7, 2021.7.20>

② 감정평가법인등은 자기 또는 친족 소유, 그 밖에 불공정하게 제10조에 따른 업무를 수행할 우려가 있다고 인정되는 토지등에 대해서는 그 업무를 수행하여서는 아니 된다. <개정 2020.4.7, 2021.7.20>

③ 감정평가법인등은 토지등의 매매업을 직접 하여서는 아니 된다. <개정 2020.4.7>

(3) An앤 appraisal어프^r레이즐 corporation,코퍼^r레이션 etc.엣세터^r러 shall섈 not낫 directly더^r렉틀리 engage엔게이지 in인 the^ð더 business비즈니스 of어^v브 buying바이잉 and앤드 selling셀링 land,랜드 etc.엣세터^r러

④ 감정평가법인등이나 그 사무직원은 제23조에 따른 수수료와 실비 외에는 어떠한 명목으로도 그 업무와 관련된 대가를 받아서는 아니 되며, 감정평가 수주의 대가로 금품 또는 재산상의 이익을 제공하거나 제공하기로 약속하여서는 아니 된다. <개정 2019.8.20, 2020.4.7>

(4) An앤 appraisal어프^r레이즐 corporation,코퍼^r레이션 etc.엣세터^r러 or오 its잇츠 office오^f피스 staff스태^f프 shall섈 not낫 receive^r러시^v브 any에니 consideration컨시더^r레이션 related^r릴레이티드 to투 their^ð데어 duties두티즈 under언더 any에니 name네임 other어^ð더 than^ð댄 the^ð더 fees^f피즈 and앤드 actual액처월 expenses익스펜시즈 under언더 Article아터클 23, and앤드 shall섈 not낫 provide프^r러^v바이드 or오 promise프^r라머스 to투 provide프^r러^v바이드 money머니 or오 other어^ð더 property프^r라퍼티 benefits베너^f핏츠 in인 return^r리턴 for^f포 being비잉 awarded어워디드 an앤 appraisal.어프^r레이즐

⑤ 감정평가사, 감정평가사가 아닌 사원 또는 이사 및 사무직원은 둘 이상의 감정평가법인(같은 법인의 주ㆍ분사무소를 포함한다) 또는 감정평가사사무소에 소속될 수 없으며, 소속된 감정평가법인 이외의 다른 감정평가법인의 주식을 소유할 수 없다. <개정 2021.7.20>

(5) A어 certified서터^f파이드 appraiser,어프^r레이저 a어 partner파트너 or오 director더^r렉터 who후 is이즈 not낫 a어 certified서터^f파이드 appraiser,어프^r레이저 and앤드 office오^f피스 staff스태^f프 may메이 not낫 belong빌롱 to투 two투 or오 more모 appraisal어프^r레이즐 corporations코퍼^r레이션즈 (including인클루딩 the^ð더 head헤드 office오^f피스 and앤드 branch브^r랜치 offices오^f퍼시즈 of어^v브 the^ð더 same세임 corporation)코퍼^r레이션 or오 certified서터^f파이드 appraiser어프^r레이저 offices,오^f퍼시즈 and앤드 may메이 not낫 own온 shares셰어즈 of어^v브 an앤 appraisal어프^r레이즐 corporation코퍼^r레이션 other어^ð더 than^ð댄 the^ð디 appraisal어프^r레이즐 corporation코퍼^r레이션 to투 which위치 they^ð데이 belong.빌롱

⑥ 감정평가법인등이나 사무직원은 제28조의2에서 정하는 유도 또는 요구에 따라서는 아니 된다. <신설 2021.7.20>
