감정평가 및 감정평가사에 관한 법률 시행령 제7조의2(감정평가서 적정성 검토의뢰인 등)
Enforcement Decree of the Act on Appraisal and Certified Appraisers, Article 7-2 (Persons Requesting Review of Appropriateness of Appraisal Reports, etc.)
① 법 제7조제3항에서 "감정평가 의뢰인 및 관계 기관 등 대통령령으로 정하는 자"란 다음 각 호의 자를 말한다. 다만, 「공익사업을 위한 토지 등의 취득 및 보상에 관한 법률」 등 관계 법령에 감정평가와 관련하여 권리구제 절차가 규정되어 있는 경우로서 권리구제 절차가 진행 중이거나 권리구제 절차를 이행할 수 있는 자(권리구제 절차의 이행이 완료된 자를 포함한다)는 제외한다.
(1) The "persons prescribed by Presidential Decree, such as appraisal clients and relevant agencies" in Article 7 (3) of the Act means the following persons. However, where a procedure for remedy of rights concerning appraisal is prescribed in relevant statutes such as the Act on Acquisition of and Compensation for Land, etc. for Public Works Projects, persons for whom the remedy procedure is in progress or who can pursue the remedy procedure (including persons who have completed the remedy procedure) are excluded:
1. 감정평가 의뢰인
1. An appraisal client;
2. 감정평가 의뢰인이 발급받은 감정평가서를 활용하는 거래나 계약 등의 상대방
2. The counterparty to a transaction or contract that makes use of an appraisal report issued to the appraisal client;
3. 감정평가 결과를 고려하여 관계 법령에 따른 인가ㆍ허가ㆍ등록 등의 여부를 판단하거나 그 밖의 업무를 수행하려는 행정기관
3. An administrative agency that intends to determine whether to grant approval, permission, registration, etc. under relevant statutes or to perform other duties in consideration of the appraisal result.
② 법 제7조제3항에서 "대통령령으로 정하는 기준을 충족하는 감정평가법인등"이란 소속된 감정평가사(감정평가사인 감정평가법인등의 대표사원, 대표이사 또는 대표자를 포함한다)가 둘 이상인 감정평가법인등을 말한다
(2) The "appraisal corporations, etc. meeting the standards prescribed by Presidential Decree" in Article 7 (3) of the Act means appraisal corporations, etc. with two or more certified appraisers belonging to them (including the representative partner, representative director, or representative of an appraisal corporation, etc. who is a certified appraiser).
