가축분뇨의 관리 및 이용에 관한 법률 시행령 제5조(축사의 이전명령에 따른 재정적 지원 등)

① 시장ㆍ군수ㆍ구청장은 법 제8조제3항에 따라 축사의 이전명령을 하는 경우 이전대상 시설 중 축사ㆍ처리시설 및 그 밖에 축사와 관련된 공작물 등(이하 "축사등"이라 한다) 토지에 정착한 물건에 대하여는 그 이전조치에 드는 비용(이하 "이전비용"이라 한다)을 보상하여야 한다. 다만, 다음 각 호의 어느 하나에 해당하는 경우에는 그 물건의 가격으로 보상하여야 한다. <개정 2015.3.24>

② 시장ㆍ군수ㆍ구청장은 제1항에 따라 축사의 이전명령에 따른 보상을 하는 경우 축사등의 소유자 등과 미리 협의하여야 한다.

③ 제1항과 제2항 외에 축사의 이전명령에 따른 재정적 지원에 관하여는 「공익사업을 위한 토지 등의 취득 및 보상에 관한 법률」에 따른다.
