법원은 가정폭력행위자에 대한 피고사건을 심리한 결과 이 법에 따른 보호처분을 하는 것이 적절하다고 인정하는 경우에는 결정으로 사건을 가정보호사건의 관할 법원에 송치할 수 있다. 이 경우 법원은 피해자의 의사를 존중하여야 한다.
