가맹사업거래의 공정화에 관한 법률 제32조의3(위반행위의 신고 등)

① 누구든지 이 법에 위반되는 사실이 있다고 인정할 때에는 그 사실을 공정거래위원회에 신고할 수 있다. 이 경우 공정거래위원회는 대통령령으로 정하는 바에 따라 신고자가 동의한 경우에는 가맹본부 또는 가맹지역본부에게 신고가 접수된 사실을 통지하여야 한다.

② 공정거래위원회는 제1항 전단에 따른 신고가 있거나 이 법에 위반되는 혐의가 있다고 인정할 때에는 필요한 조사를 할 수 있다.

③ 제1항 후단에 따라 공정거래위원회가 가맹본부 또는 가맹지역본부에게 통지한 때에는 「민법」 제174조에 따른 최고가 있은 것으로 본다. 다만, 신고된 사실이 이 법의 적용대상이 아니거나 제32조제1항 본문에 따른 조사개시대상행위의 제한 기한을 경과하여 공정거래위원회가 심의절차를 진행하지 아니하기로 한 경우, 신고된 사실에 대하여 공정거래위원회가 무혐의로 조치한 경우 또는 신고인이 신고를 취하한 경우에는 그러하지 아니하다. <개정 2018.12.31>

④ 공정거래위원회는 제2항에 따라 조사를 한 경우에는 그 결과(조사결과 시정조치 명령 등의 처분을 하고자 하는 경우에는 그 처분의 내용을 포함한다)를 서면으로 해당 사건의 당사자에게 통지하여야 한다.
