Fair Transactions in Franchise Business Act, Article 27 (Franchise Transaction Specialists)

①공정거래위원회가 실시하는 가맹거래사 자격시험에 합격한 후 대통령령이 정하는 바에 따라 실무수습을 마친 자는 가맹거래사의 자격을 가진다. <개정 2004.1.20, 2007.8.3>

(1) A어 person퍼슨 who후 has해즈 passed패스트 the^ð더 franchise^f프^r랜차이즈 transaction트^r랜잭션 specialist스페셜리스트 qualification콸러^f퍼케이션 examination이그재머네이션 administered어드미너스터드 by바이 the^ð더 Fair^f페어 Trade트^r레이드 Commission커미션 and앤드 completed컴플리티드 practical프^r랙터클 training,트^r레이닝 as애즈 prescribed프^r리스크^r라이브드 by바이 Presidential프^r레저덴실 Decree,디크^r리 has해즈 the^ð더 qualification콸러^f퍼케이션 of어^v브 franchise^f프^r랜차이즈 transaction트^r랜잭션 specialist.스페셜리스트

②다음 각 호의 어느 하나에 해당하는 자는 가맹거래사가 될 수 없다. <개정 2007.8.3, 2017.4.18, 2021.4.20>

(2) A어 person퍼슨 falling^f팔링 under언더 any에니 of어^v브 the^ð더 following^f팔로잉 cannot캐낫 become비컴 a어 franchise^f프^r랜차이즈 transaction트^r랜잭션 specialist:스페셜리스트

1. 미성년자 또는 피성년후견인

1. A어 minor마이너 or오 a어 person퍼슨 under언더 adult어덜트 guardianship;가디언쉽

2. 파산선고를 받고 복권되지 아니한 자

2. A어 person퍼슨 who후 has해즈 been빈 declared디클레어드 bankrupt뱅크^r럽트 and앤드 not낫 been빈 reinstated;^r리인스테이티드

3. 금고 이상의 실형의 선고를 받고 그 집행이 종료(종료된 것으로 보는 경우를 포함한다)되거나 집행을 받지 아니하기로 확정된 후 2년이 경과되지 아니한 자

4. 금고 이상의 형의 집행유예를 받고 그 집행유예기간중에 있는 자

5. 제31조의 규정에 의하여 가맹거래사의 등록이 취소된 날부터 2년이 경과되지 아니한 자

③ 제1항에 따른 시험에 응시한 사람이 그 시험에 관하여 부정한 행위를 한 경우에는 해당 시험을 무효로 하고 그 시험의 응시일부터 5년간 시험의 응시자격을 정지한다. <신설 2016.3.29>
